Applications

According to the principles set out in the Storage Code:

  • The Applicant shall be required to submit the application for a Long-Term SSA or Short-Term SSA via a the SSP, unless the SSO decides to carry out the Application Procedure in another form, in particular due to a failure or malfunction of the System. Apart from the above mentioned exception, Applications submitted outside the System shall not be considered.
  • The following steps shall be required in order to submit an Application through a the SSP:
    • registration on the SSP in accordance with the provisions of the SSP Terms and Conditions;
    • conclusion of the Framework SSA, if it has not already been concluded;
  • In order to conclude a Long-Term SSA or Short-Term SSA, the Applicant shall be required to submit an Application for, as applicable, a Long-Term SSA or Short-term SSA within the time limit for the submission of applications as specified under a given Application Procedure.

Together with the Application for a Long-Term or Short-Term SSA, according to section 3.3.1.4 the Storage Code, the following documents should be submitted through the SSP:

  • the declaration referred to in clause 2.7.6. the Storage Code when the Applicant submits the Application to create a mandatory stock; to be submitted in the form of a digital document with a qualified electronic signature or, if not possible, in the form of a scan of the signed document, subject to clause 5.1.6. the Storage Code;
  • the Applicant’s declarations in the form of digital documents with a qualified electronic signature, or, if not possible, in the form of a scan of the signed document, subject to clause 5.1.6. the Storage Code, confirming that:

– the Applicant is the owner of the Gaseous Fuel to be injected to a Storage Facility or a Group of Storage Facilities under the Storage Service being subject to the Application, substantially in the form referred to in section 1.10.1.11 the Storage Code (Form of the Applicant’s declaration on the legal title to Gaseous Fuel), and a declaration containing the Applicant’s irrevocable offer to sell the Gaseous Fuel in the circumstances and subject to the conditions described in section 4.8. the Storage Code, substantially in the form referred to in section 1.10.1.12. the Storage Code (Form of the Applicant’s declaration containing the offer to sell Gaseous Fuel),

or

– in case when the Applicant is not the owner of the Gaseous Fuel – a declaration of the Applicant’s title to the Gaseous Fuel substantially in the form referred to in section 1.10.1.11. Storage Code (Form of the Applicant’s declaration on the legal title to Gaseous Fuel), and a declaration of the owner of the Gaseous Fuel containing its consent for the execution of the SSA and a declaration of the owner of the Gaseous Fuel containing its irrevocable offer to sell the Gaseous Fuel in the circumstances and subject to the conditions described in section the General Terms and Conditions of the Storage Services Agreement (“GTC”), substantially in the form referred to in section 1.10.1.13. the Storage Code (Form of the declaration of the Owner of Gaseous Fuel (if other than the Applicant) on the consent to the execution of a SSA and containing the offer to sell Gaseous Fuel);

  • a scan of the Transmission Ability Allocation that will enable the delivery of Gaseous Fuel to the Storage Facility or the Group of Storage Facilities, or the collection of the said fuel from the Storage Facility or Group of Storage Facilities;
  • a scan of documents, and in case of documents executed in electronic form with a qualified electronic signature – a scan or originals of such documents in electronic form, enabling the verification of the Applicant’s financial standing, i.e.:

– documents confirming the financial rating held by the Applicant in accordance with the provisions of the GTC (if the Applicant has such a rating)

The Applicant that has obtained and provides evidence of a credit rating of at least: Baa2 for Moody’s, or BBB for Standard and Poor’s, or BBB for Fitch, shall not be required to present any additional performance security instruments to demonstrate its creditworthiness.

or

– in case the Applicant submits an Application for a Long-Term SSA and does not have the rating referred to above – approved separate financial statements for the last financial year and other documents indicated in section 2.5. the GTC enabling the verification of the Applicant’s financial credibility,

unless the documents have been submitted together with the Application for conclusion of the Framework Storage Services Agreement and are still valid.

Application for a Long-Term Storage Services Agreement be submitted on the SSP only under an ongoing Application Procedure, provided that:

  • The Application Procedure concerning the Long-Term SSA shall be carried out at least once a year, at a date that allows for Storage Capacity to be made available for the coming Storage Year. The Application submission period under the procedure, for Applications to be considered on a pro-rata rule, shall begin no later than at 03:00 p.m. on 1 February of the calendar year in which the provision of Storage Service is to start, and shall end at 03:00 p.m. on 20 February of the calendar year in which the Storage Year in which the provision of Storage Services is to begin, will start. When the above dates fall on a day other than a Business Day, they will be adjusted accordingly so that they fall on the first following Business Day.
  • Under the annual procedure described above, the SSO may indicate another date (time interval) during which it will be possible to submit Applications to be considered on the basis of the first-come-first-served (FCFS) rule first-come-first-served unless all Storage Capacity is allocated under earlier Applications considered according to the pro rata ruleThe submission date for Applications to be considered according to the FCFS rule shall begin following the conclusion of submission period for Applications to be considered according to the pro-rata rule and end at 03:00 p.m. on 17 March of the calendar year in which the Storage Year in which the provision of Storage Services is to begin starts.

Application for Short-Term Storage Services Agreement be submitted on the SSP only under an ongoing Application Procedure. 

The storage facilities at which the SSO provides the storage services are connected to high-methane gas system operated by Gas Transmission System Operator GAZ-SYSTEM S.A. (TSO). The cooperation between the SSO and the TSO is governed by the Network Code the Inter-operator Transmission Contract (ITC) and the Inter-operator Agreement.

Capacity allocation

Under the ITC, the SSO obtains capacity allocation (PP) from the TSO at the points of interconnection between the transmission system and the respective storage facilities.

Transmission ability allocation

A party applying for a Storage Services Agreement (SSA) in respect of entry or exit points at the interconnection between the transmission system and a storage facility (PWYOSM and PWEOSM) should have a transmission contract with the TSO and obtain a transmission ability allocation (PZ) from the TSO with respect to such points, in accordance with the procedure described in Section 8 of the Network Code. When the applying party has already obtained the transmission ability allocation, the Storage Services Agreement (SSA) is executed.

In case when the applicant does not yet have the allocation, the SSO enters into a conditional SSA which is subject to a condition precedent that the applicant presents a transmission ability allocation (PZ) obtained from the TSO within a predefined time limit. The transmission ability allocation must enable the transmission of the quantities of gaseous fuel being subject to the SSA before the provision of storage services begins. The condition precedent is deemed to have been fulfilled when the Storage Customer advises the SSO that it has obtained the transmission ability allocation.

According to the provisions of the Network Code, each customer of the SSO having a valid transmission contract with the TSO may obtain the transmission ability allocation (PZ) at the points of entry to and exit from the transmission system from/to storage facilities up to the level corresponding to the capacity allocated to the SSO, expressed in energy units.

Nominations and renominations for PWYOSM and PWEOSM

Nominations and renominations for the injection and withdrawal of gaseous fuel to/from respective entry and exit pointsOSM and PWEOSM are submitted in kWh by the party concerned acting as a Storage Customer with respect to the SSO (according to Storage Code) and as a Shipper with respect to the TSO (according to the Network Code).
The nominations and renominations submitted to the SSO should be consistent with the relevant nominations and renominations submitted to the TSO.

The TSO provides the SSO with information on the nominations submitted by the Shipper. The SSO verifies whether the nominations and renominations submitted to the SSO and the TSO match each other. In case of any inconsistency being discovered, the lesser rule applies, i.e. the nomination for the lesser quantity will be executed. The SSO advises the TSO of the result of the nomination and renomination matching.

The exchange of information between the SSO, the TSO and Storage Customers regarding nominations, renominations and allocations is based on the electronic document interchange standard (EDI) according to the dedicated version developed for gas industry under the name EDIG@S, in xml format.

Execution of nominations

An approved nomination of the Storage Customer is executed in full pursuant to the Inter-operator Agreement between the SSO and the TSO. Accordingly, the allocation of the injected or withdrawn gaseous fuel made by the SSO equals the approved nomination.
