Gas Storage Poland sp. z o. o. with its registered office in Debogórze (“GSP”) informs that the last valid version of the Storage Service Rules (the “Rules”) was version 004 of 01 April 2022 with Amendment No. 1 of May 20^th, 2022 (“Amendment No. 1 to the Rules version 004”), with Amendment No. 2 of August 9^th, 2022 (“Amendment No. 2 to the Rules version 004”),with Amendment No. 3 of September 13^th, 2022 (“Amendment No. 3 to the Rules version 004”),with Amendment No. 4 of November 9^th, 2022 (“Amendment No. 4 to the Rules version 004”) and with Amendment No. 5 of June 19^th, 2023 (“Amendment No. 5 to the Rules version 004”).

Amendment No. 5 to the Rules version 004 has entered into force as of 6.00 a.m. on 1 July 2023, that is from the beginning of the Gas Day in which Gas Storage Services Tariff No. 1/2023 reflecting the modified specifications of the Storage Services, as approved and published by the President of the ERO, starts to apply, subject to Appendix No. 9A and Appendix No. 9B to the Rules, which contain information clauses concerning the processing of personal data of representatives, employees and associates of the clients of GSP. Appendix 9A and Appendix 9B to the Rules has entered into force on the date of announcement of Amendment No. 5, i.e. on 19.06.2023. Changes included in Amendment No. 5 of the Rules, in accordance with point 1.7.8.1. and 1.7.8.3. of the Rules do not require market consultations.

Amendment No. 4 to the Rules after consultations with the market has entered into force as  of 6.00 a.m. on 09.11. 2022. The GSP did not receive any comments on Amendment No. 4 to the Rules. Amendment No. 4 to the Rules is intended to align the provisions of Schedule 9 A and Schedule 9B to the Rules, which contain information clauses concerning the processing of personal data of representatives, employees and associates of the clients of Gas Storage Poland sp. z o. o. (“GSP”), and of the clients of GSP.

Amendment No. 3 to the Rules has entered into force as of 6.00 a.m. on 1 October 2022, that is from the beginning of the Gas Day in which an amendment to Tariff 1/2022 reflecting the modified specifications of the Storage Services, as approved and published by the President of the ERO, starts to apply, subject to clauses. 9.6 – 9.9 of the Rules. Clauses 9.6 – 9.9 of the Rules have entered of the date of promulgation of Amendment No. 3, i.e. on 13.09.2022. The procedure of the implementation of Amendment No. 3 results from the need to introduce changes to the Rules resulting from the Article 70d of the Act of 16 February 2007 on the stockpiling of crude oil, petroleum products and natural gas and on the operating procedures applicable in emergencies involving state fuel security or oil market disturbances (for consolidated text see: Journal of Laws of 2022, item 1537, hereinafter: the “Stockpiling Act”), effective as of 1 September 2022 pursuant to Article 2(14) of the Act of 5 August 2022 amending certain acts to strengthen the state’s gas security in connection with the situation in the gas market  (Journal of Laws of 2022, item 1723), which, according to the intentions of the legislature, are to provide the entities obliged to maintain mandatory stocks of natural gas with additional flexibility in the use of Storage Capacity in the event of a crisis situation, and thus to strengthen Poland’s gas security.

Amendment No. 2 to the Rules version 004 has entered  into force as of 6.00 a.m. on 10.08.2022. The postponement of the initial date from which the Autumn Maintenance Downtime Period in Storage Facility may begin at the earliest, i.e. from 6.00 on September 1 at 6.00 on August 1. Amendment No. 1 to the Rules version 004 has entered into force as of 6.00 a.m. on 4.06.2022 r., i.e. on the date of introduction of Tariff 1/2022 for application.

The revised provisions of the Rules indicated in Amendment No. 1 to the Rules version 004 include:

• changes to the Technical Specifications of Firm Long-Term and Short-Term Storage Services in GSF Kawerna set out in clause 6.1.3.1. and clause 6.1.3.3. of Part II of the Rules version 004. In accordance with clause 1.7.8.3 of the Rules version 004, market consultations did not required with respect to the above changes.
• alignment of the provisions of the Rules with Tariff 1/2022 and the repeal of the provisions concerning the 90/40 Storage Service from the Rules. The amendment in this regard has been introduced pursuant to clause 1.7.7 of the Rules and was subject to consultations following its introduction.

The SSR version 004 was effective from 6:00 am on April 15, 2022 till 6:00 am on November 6, 2023.
